Sounds like the best workaround for this is to have a deadman switch to delete all data if the phone hasn’t been unlocked in a 24 hour period? Then it is your inaction that results in the destruction of the data, and you’d still be complying with the statute.

Not really knowing the drama before today, it seems like he is being very rational and speaking honestly about the effects LLMs are having on his behavior and that he identified he needs to change, which is what the whole article is about.

You’re right, i reread the article and it mentions similar lawsuits against Sony / Microsoft, so they all suck. I think the reason Nintendo is being singled out here is because there is not a lot of news with those other lawsuits, but with this one, Nintendo is trying to dismiss the case saying plaintiffs:
“received exactly what they paid for: Nintendo products that Plaintiffs knowingly and voluntarily purchased at the advertised price. Nor is there anything ‘unjust’ about Nintendo retaining money that it may receive from the government as tariff refunds. The fact that Nintendo stands to receive tariff refunds does not give Plaintiffs any legal entitlement to those funds.”
With Nintendo’s litigious history and them being the first to try to dismiss the case with this argument, they deserve the blowback they’re getting from their own customers.

Nintendo is being singled out because they’re withholding the tariff refunds for tariffs they never paid and passed on to the customers. When the tariffs were imposed, no one really blamed Nintendo and knew it was the Administration’s fault. If Nintendo didn’t want sales to drop because of higher prices, they could have eaten the additional tariff cost until it all got sorted out. Had they done this, then they’d be entitled to that tariff refund money. Instead they passed on the tariff cost to customers, which sucks for customers but was really the only sensible thing Nintendo could have done given the circumstances, and most people aren’t really blaming Nintendo on that decision. But now Nintendo is trying to have it both ways, not pay any of the tariffs and keep all of the tariff refunds which is why they’re being singled out. It’s pure greed on their part with blatant disrespect to their customers.
I took a look at it earlier today and the addition of instances to be blocked was super shady and sloppy on part of the maintainer. Also apparently the error you’d get when going to the blocked instance was a generic error which makes the user think there’s a network issue or incompatibility with the API or something and the idea of a hard coded blocklist is never presented to the user as the source of the issue.
That sounds like a terrible store policy. Couldn’t the cartridge have been scuffed up when it was in the drawer behind the counter, even if new? Honestly I wouldn’t buy from EB Games if this is their policy and you have concerns of getting a used game (either accidentally or nefariously).

I imagine most of their revenue comes from the ad supported “channels” they provide, which non-technical people are tricked into using since they have a technical friend or relative who set them up with Plex 10 years ago. With the Fox acquisition of Roku, the merging of Tubi and Roku Channel would be huge and probably cause Plex to lose streaming licenses of certain properties which will end up as lower revenue.
Do they mention if the trackers were private? It’ll be interesting to see in discovery the details of the trackers and which ones are being monitored by the industry.
